You should speak with a lawyer about how you can minimize the amount of money you need to repay and what is the best course of action. In some cases it might be better to try and settle for a lump sum payment. If you start a repayment program, you might find hidden charges and interest mean you will be paying back for a long time to come. Losing some of your assets that are very important to your livelihood is a very real issue.
  • Try and reach a settlement before court.You can always try to reach a settlement before going to court. This will depend on the nature of the collection agency that you are now dealing with. If they are being unreasonable, you will have no option. Remember, they have the right to enforce the letter of the contract under the laws of your region. There is no reason for them to stop going after what you signed on for.
  • Definitely turn up. You absolutely must go. If you do not, you have automatically lost your case. In the case of a payday or other fast loan, when you have defaulted, the major issues related to you paying the money back that will cost you a lot of money, are not so much the amount you have borrowed, but the amount of extra charges you are going to be hit with. If you don’t turn up to defend yourself, and try to minimize these charges, you could be in debt for a very large amount. Hopefully, you have read the terms of your contract very carefully, you might have agreed to give up items of value to repay the loan – this is often the case with these types of contracts.
  • Plead your case. Your only goal in the small claims court will be to minimize the financial damage that you are about to endure. It is only your willingness to settle the situation in a reasonable manner that will help you in the court.

Contracts related to short term cash loans are very tight. They should only be used when you are sure you can pay them back on time. The amount you will be in debt for because of this small loan can be many times more than what you borrowed if you do not pay on time.
